DEALING WITH TAXES

Depending on the size of the estate, there are a number of tax issues that must be considered in an estate plan. As of 2021, there is a federal estate tax applied to estates for any amount over $11.7 million. This is known as the federal estate tax exemption and is slated to be indexed for inflation in each successive year.

In Minnesota, there is an estate tax for any estate greater than $3 million. Each type of estate — smaller than the Minnesota tax exemption, between the Minnesota tax exemption and the federal tax exemption, and greater than the federal tax exemption — requires careful planning to accomplish our clients’ goals and minimize estate taxes.

Wisconsin does not presently have a state estate tax.

Your estate plan can minimize estate taxes with strategies such as the use of an irrevocable life insurance trust.

We can also help you consider any gift tax issues. Federal estate tax credit is unified with the gift tax and the annual gift tax exclusion is $15,000. Minnesota does not have a gift tax but they have a three year look back period for large gifts near the end of life.
